Terms of Service

Operator: Marcin (hereinafter referred to as “we”, “us”, or “our”), operator of the website https://jofmkh.com/ (hereinafter referred to as “the Platform”) and provider of handcrafted Mini Bag Model Decorations (hereinafter referred to as “Products”).
 
Applicable Scope: These Terms of Service (hereinafter referred to as “these Terms”) govern your access to and use of the Platform, purchase of Products, and use of related services (including order processing, customer service, shipping, and after-sales support, collectively referred to as “Services”).
 
By accessing the Platform, creating an account, or purchasing Products, you (hereinafter referred to as “you” or “User”) acknowledge that you have fully read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy and Refund Policy (which are incorporated herein as integral parts). If you do not agree to any provision of these Terms, you must immediately cease using the Platform and Services.

1. Acceptance of Terms

1.1 These Terms constitute a legally binding agreement between you and us. We may update these Terms from time to time to comply with changes in laws (e.g., the EU General Data Protection Regulation (GDPR) and Poland’s Data Protection Act) or business needs.
 
1.2 Updated Terms will be posted on the Platform with a new “Effective Date”. If you continue to use the Platform or Services after the update, you are deemed to have accepted the revised Terms. If you disagree with the updates, you must stop using the Platform and Services immediately.

2. Definitions

  • Platform: The website https://jofmkh.com/ and any future derivatives (e.g., mobile versions) operated by us.
  • Products: Handcrafted Mini Bag Model Decorations sold on the Platform, as described in product listings (including specifications, colors, and materials).
  • Services: All services provided by us, including but not limited to product display, order placement, payment processing, shipping, and after-sales support.
  • User Content: Any information you submit to the Platform, such as reviews, comments, or photos (excluding personal information covered by the Privacy Policy).
  • Third-Party Services: Services provided by external partners, such as payment processors (e.g., PayPal) and logistics providers (e.g., Polish Post), which are governed by their own terms of service.

3. Eligibility to Use Services

3.1 You represent and warrant that:
 
  • You are at least 18 years old (or have obtained written consent from a parent/legal guardian if you are a minor under 18).
  • You have the legal capacity to enter into these Terms (e.g., if you act on behalf of a company, you have the authority to bind that company to these Terms).
  • You are not subject to trade restrictions, sanctions, or legal prohibitions from any country/region (including the EU and Poland) that would prevent you from using the Services.
     
    3.2 We reserve the right to verify your eligibility (e.g., requesting identification for age verification) and may refuse or terminate Services if you fail to meet these requirements.

4. Account Registration and Use

4.1 Account Creation: To purchase Products or access full Services, you may need to create an account by providing accurate, complete, and up-to-date information (e.g., name, email address, shipping address). You are responsible for maintaining the confidentiality of your account password and for all activities conducted under your account.
 
4.2 Account Restrictions:
 
  • Your account is for your personal use only. You may not transfer, lend, or share your account with any third party.
  • If you discover unauthorized use of your account (e.g., stolen password), you must notify us immediately. We will not be liable for losses caused by your failure to protect your account.
     
    4.3 Inactive Account Recycling: If your account meets all of the following conditions, we may delete it without prior notice:
  • It has not been used to log in to the Platform for 12 consecutive months.
  • There are no pending orders, unpaid balances, or unresolved disputes.
  • It has not completed required identity verification (if applicable).

5. Description of Services

5.1 Core Services:
 
  • Displaying detailed information about Products (e.g., materials, dimensions, colors, prices).
  • Processing orders and payments (via secure third-party payment processors).
  • Providing free worldwide shipping and returns (as stated in the Refund Policy).
  • Offering customer service to address inquiries, complaints, or after-sales issues.
     
    5.2 Service Limitations:
  • We provide Services “as is” and do not guarantee that the Platform will be error-free, uninterrupted, or compatible with all devices/browsers.
  • Product stock is subject to availability. We reserve the right to cancel orders if Products are out of stock (you will be notified and refunded in full within 3 business days).
  • Minor variations in Product appearance (e.g., slight color differences in handcrafted leather) are normal and do not constitute a defect.

6. User Obligations

You agree to comply with the following when using the Platform and Services:
 
6.1 Do not use the Platform for illegal purposes (e.g., fraud, money laundering, or selling counterfeit goods).
 
6.2 Do not submit false, misleading, or inaccurate information (e.g., fake shipping addresses, forged payment details).
 
6.3 Do not interfere with the Platform’s operation (e.g., hacking, introducing malware, or overloading servers).
 
6.4 Do not infringe our or third-party intellectual property rights (e.g., copying Product photos, logos, or descriptions for commercial use without permission).
 
6.5 Do not post offensive, defamatory, or illegal User Content (e.g., hate speech, obscenity, or personal attacks). We reserve the right to delete such content and suspend/terminate your account without notice.

7. Intellectual Property Rights

7.1 All intellectual property rights in the Platform and Services (including but not limited to logos, Product designs, photos, text, and software) belong to us or our authorized licensors. You may not reproduce, modify, distribute, or sell these materials without our prior written consent.
 
7.2 For User Content you submit (e.g., product reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce such content on the Platform for marketing or service improvement purposes. You warrant that you own the intellectual property rights to the User Content and that it does not infringe any third-party rights.

8. Privacy Protection

We respect your privacy and process your personal information in accordance with our Privacy Policy (compliant with GDPR and Polish data protection laws). By using the Services, you consent to the collection, use, and storage of your personal information as described in the Privacy Policy.

9. Order and Transaction Terms

9.1 Order Formation: An order is deemed confirmed when we send you an order confirmation email (after verifying your payment).
 
9.2 Payment: You must complete payment using the Platform’s designated methods (e.g., credit card, PayPal). We do not store your full payment information—all payment data is processed securely by third-party payment providers (subject to their privacy policies).
 
9.3 Shipping and Delivery: We will ship Products within 3–5 business days of order confirmation. Delivery times vary by region (typically 7–14 business days for EU countries, 10–21 business days for other countries). You may track your order via the link in the shipping confirmation email.
 
9.4 Refunds and Returns: All refund and return requests are governed by our Refund Policy. You must comply with the procedures and time limits specified therein to be eligible for a refund.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, we shall not be liable for:
 
  • Indirect, incidental, or consequential losses (e.g., loss of profits, business interruption, or emotional distress) arising from your use of the Services.
  • Losses caused by factors beyond our control (e.g., natural disasters, logistics delays, or third-party service failures).
  • Losses caused by your non-compliance with these Terms (e.g., unauthorized account use, false information).
     
    10.2 Our total liability for any claim arising from these Terms or the Services shall not exceed the total amount you paid for the relevant Product(s) in the past 12 months.

11. Termination of Services

11.1 We may suspend or terminate your access to the Platform/Services immediately without prior notice if:
 
  • You violate any provision of these Terms (e.g., fraud, intellectual property infringement).
  • You are subject to legal sanctions or trade restrictions.
  • We reasonably believe your use of the Services poses a risk to the Platform, other Users, or our legal interests.
     
    11.2 Upon termination:
  • You must cease using the Platform and Services immediately.
  • Unfulfilled orders will be canceled (you will receive a full refund for paid orders).
  • We may retain your personal information in accordance with the Privacy Policy (e.g., for legal record-keeping).

12. Dispute Resolution

12.1 All disputes arising from these Terms or the Services shall first be resolved through friendly negotiation between you and us. If negotiation fails, the dispute shall be submitted to the district court of Milówka, Poland for resolution (in accordance with Polish law).
 
12.2 If you are an EU User, you also have the right to file a complaint with the Polish Data Protection Authority (Urząd Ochrony Danych Osobowych, UODO) if you believe your data rights under GDPR have been violated.

13. General Provisions

13.1 Severability: If any provision of these Terms is deemed invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
 
13.2 Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Platform and Services, replacing all prior oral or written agreements.
 
13.3 No Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or our right to enforce it in the future.
